Proving Negligence in a Pennsylvania Slip-and-Fall Accident

Not all slip-and-fall accidents in Pennsylvania automatically turn into civil lawsuits. In order to pursue compensation through civil litigation, the injured victim will have to prove that the property owner's or some other individual's or entity's negligence played a part in the accident. This process is not always easy and can be rather challenging.

There are a number of questions that must be asked following a slip-and-fall accident. What caused the victim to fall? Did a dangerous or hazardous condition on the property contribute to the crash? Was the owner or property manager aware of the hazardous condition? Were there warning signs posted? Did the property owner fail to fix the dangerous condition in a timely manner? Could the accident have been prevented? Did the victim suffer an injury or loss in the accident?

Receiving fair compensation for a Pennsylvania slip-and-fall accident is difficult because it must be proven that the accident resulted from someone's negligence. In cases where negligence played a part in the accident, compensation may be available for the injured victim through civil litigation. Damages that may be covered by a premises liability claim include medical bills, past and future suffering, cost of physical therapy, lost wages, and more.

The experienced slip-and-fall accident attorneys in Philadelphia at Anapol Schwartz have a proven history of successfully handling personal injury cases in Pennsylvania, including slip-and-fall accidents. According to PhillyBurbs.com, the fatal accident occurred on Byberry Road in Upper Moreland. Child Killed in Philadelphia House with No Smoke Alarms

A 4-year-old boy was killed and two teenagers were injured in a Philadelphia fire that remains under investigation. According to WPVI, the fatal house fire occurred on Herman Street in the Germantown section of Philadelphia the afternoon of July 2, 2011. A teenage boy and girl were able to escape from the second floor of the home by jumping onto a tree but the 4-year-old boy could not get out. Firefighters extinguished the fire in 20 minutes and they found the boy unconscious and badly burned. The cause of the fire is unknown, but it has been reported that the home had no working fire alarms.

The report goes on to say that 26 people have been killed in Philadelphia fires this year. Last year at this same time, 17 people had been killed in Philadelphia fires. According to a report in The Philadelphia Daily News, 201 people were injured and 33 were killed in Philadelphia fires in the year 2009. In an attempt to limit the number of fatal fires, Philadelphia firefighters installed 16,000 smoke alarms for free in 2009.

Property owners are required to provide fire extinguishers and fire alarms that are in good working condition. Buildings should be built to code and residents should have multiple escape options.

If you have been injured or if you have lost one in a fire as a result of someone else's negligence, the experienced Philadelphia injury attorneys at Anapol Schwartz can help. Call our offices right away at 1-866-735-2792 to discuss your legal rights and options.

Celebrating July 4 with Fireworks the Safe Way

Independence Day in America is a joyous holiday when family and friends get together to barbecue, share their patriotism, and enjoy fireworks. While Pennsylvania state law prohibits the use of consumer and display fireworks, items collectively known as “novelties” (such as ground and hand-held sparkling devices and toy caps), may be sold and used within the state. The use of these fireworks is common during the Independence Day holiday.

Although these novelty fireworks may appear small and harmless, it is important that consumers take precautions to make sure they are used safely. According to statistics released by the U.S. Consumer Product Safety Commission (CPSC), in the 30 days surrounding July 4, 2010, about 1,900 people were treated in the country's hospital emergency rooms for fireworks-related injuries. In all of 2010, 8,600 people in the United States received treatment in emergency rooms for fireworks-related injuries. About 40 percent of those injured were 15-years-old or younger. There were three fatalities in 2010 related to fireworks.

Those who purchase legal fireworks this Fourth of July would be well-advised to take the precautions necessary to ensure that a joyous occasion does not turn into a tragic one. Never allow children to set off fireworks. Avoid buying fireworks that are packaged in brown paper because this is a sign that they were manufactured for professional displays. All fireworks activities must be supervised by adults. Grown-ups tend to be casual about use of fireworks such as sparklers, but CPSC officials warn that sparklers burn at temperatures of 2,000 degrees, which is hot enough to melt some metals.

If you or a loved one has been injured as a result of negligent use of fireworks, please contact an experienced personal injury lawyer in Philadelphia, such as those at Anapol Schwartz. We have a long and successful track record of helping personal injury victims and their families obtain just compensation for their injuries, damages, and losses.
