$1.85 Million Settlement in Wrongful Death Auto Accident

Multimillion-Dollar Advocates Forum members Christopher Marzzacco recently settled a $1.85 million wrongful death claim out-of court on behalf of the parents and the estate of a 20-year-old man killed in an auto accident involving a commercial refuse truck.

Ursula Culpepper and Demetrius Ayler filed a wrongful death and survival action petition against  York-based Tiger Trash and Joseph Newson –the driver of the truck that fatally injured their son, Philip Ayler on May 19, 2014.

Ayler was driving Northbound down a Harrisburg street when Newson’s commercial hauling truck hit an overpass and toppled over onto its side. The truck landed on top of the vehicle Ayler was diving and pinned him inside.  Emergency crews extricated Ayler from the vehicle and transported him to Harrisburg hospital where he was pronounced dead.  Dauphin County Coroner Graham Hetrick declared traumatic brain injuries as the official cause of death, reported PennLive.

Prior to the crash, Newson recently completed a container drop-off and neglected to lower the truck’s “boom.” The elevated boom struck the overpass and caused the deadly collision. Had the boom been in player, Ayler might still be alive today.

In addition to negotiations with the defendant’s insurance companies, Marzzacco, a car accident lawyer in Pennsylvania, settled an underinsured motorist claim with Ayler’s insurers.

Dauphin County President Judge Richard A. Lewis formally approved the settlement on April 16, 2015.

Ayler was a graduate of Harrisburg High School and was working two full-time jobs with plans of becoming a certified commercial truck driver.
